FIRM WINS DISMISSAL OF PATIENT ABUSE CLAIM AGAINST ANCORA HOSPITAL ALONG WITH CASH SETTLEMENT.
In the matter of Ancora v. The Estate of Gregory Graham, Ancora Psychiatric Hospital, OAL Docket No. CSV-10397-09. Administrative Law Judge Robert Blake approved a Settlement Agreement between the Estate of fired hospital employee, Gregory Graham and Ancora Psychiatric Hospital. Gregory Graham was charged with the abuse of an Ancora Psychiatric Hospital patient following Graham’s coming aid to a nurse who was being viciously attacked and battered by the psychiatric patient. The employee, Graham, applied hospital approved Handle with Care restraints to diffuse the attack and rescue the nurse. Nonetheless, the Hospital brought Dismissal Charges against Graham from his position as a Human Services Technician.
Following the start of trial, the Hospital agreed to rescind the charges against the Graham and reinstated him with back pay. Unfortunately, the employee died prior to his filing of the appeal. The reinstatement nonetheless, enabled the employee to become retroactively eligible for the reinstatement of a six figure life insurance policy which was paid to the heirs of the deceased employee. The charges against Mr. Graham were expunged from his record and he was paid back pay. The Settlement and Order is attached.
