FIRM WINS INJUNCTION AGAINST STATE OF NEW JERSEY IN UNFAIR LABOR PRACTICE MATTER. RUFFIN V. STATE OF NEW JERSEY DEPARTMENT OF HEALTH AND HUMAN SERVICES AND ANCORA HOSPITAL, DOCKET NO.: CO-2011-221.
The Gompers Law Firm won an injunction barring Ancora State Psychiatric Hospital from prohibiting a Union Local President from gaining access to Union offices located on State Hospital grounds during the pendency of a disciplinary suspension. The Firm filed for a TRO Motion before the NJ Public Employment Relations Commission claiming an Unfair Labor Practice against Ancora Hospital which suspended a Union Local President on disputed disciplinary charges and then sought to bar that Union Official from conducting Union activities on State Hospital grounds during the pendency of his disciplinary suspension and appeal. The Gompers Firm filed an Unfair Labor Practice Complaint before the Public Employment Relations Commission which resulted in an injunction against Ancora Hospital and the State of New Jersey. The Public Employment Relations Commission held that the State was not permitted to bar the Union Officer from conducting Union activities even if he was prohibited from attending work.
