FEDERAL COURT DISMISSES CORPORATE COMPUTER FRAUD AND ABUSE ACT CLAIM.

On March 6, 2012, United States District Court Judge Robert Kelly dismissed a case brought by a former employer against the company’s former Chief Technology Officer. In granting the employee’s Motion to Dismiss filed by the Gompers firm, the Federal Court agreed that the employee’s lawsuit failed to state a legal claim upon which relief could be granted. Subsequent to the Dismissal of the Complaint, the Pennsylvania Department of Insurance placed the company in a receivership.

The employer has since issued the attached letter to the employer’s absolving him of all involvement. A copy of that letter is attached as is the Court’s Opinion.
