Actor’s Death and Auto Defect Accident

In June of 2016, actor Anton Yelchin, known for roles in “Star Trek: Beyond” and “Green Room,” lost his life in an accident caused by an auto defect. Yelchin’s vehicle, which he had thought was parked, rolled down his driveway and pinned him against his entrance gate. It is believed that this was a wrongful death caused by a defective electronic transmission shift in a now recalled Jeep. Philadelphia wrongful death lawyers report that the actor’s family is seeking punitive damages.

The Family’s Case

Yelchin’s family claims that the company responsible for manufacturing the vehicle was aware that the model was defective, and distributed them anyway. The suit alleges that the company did not take proper precautions to ensure the safety of their vehicles. The suit sets forth that Fiat Chrylser was aware that there was an auto defect in the gear shift which made it unclear whether the car was in park or not. Yelchin’s family claims to be filing the suit both for compensation and as a preventative measure, in order to ensure that the problem is dealt with.

A Recurring Defect

According to a report filed by the National Highway Traffic Safety Administration, Yelchin’s accident was not the first of its kind with this model of vehicle. The Jeep auto defect in the gear shift has led to nearly 700 complaints, 266 crashes and fires, and 68 outright injuries. A recall order was issued, but not in time to prevent Yelchin’s death.

Wrongful Death Suits

In situations such as these, a wrongful death suit can be an important way for families to receive compensation as well as a sense of justice for the punitive fees against the responsible parties. In the case of a fatal injury caused by an auto defect, it is important to determine who is at fault. Yelchin’s family is suing both the car manufacturer as well as the manufacturer of the gear shift itself.
